These Terms of Service ("Terms") govern your access to and use of the services provided by Perception Cards through our website, web-based services, NFC-enabled products, and any related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

Acceptance of Terms

Your continued use of the Service constitutes acceptance of these Terms and any updates or modifications. We encourage you to review these Terms periodically.

Use of the Service

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You may not:

  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt system integrity or performance
  • Exploit, manipulate, or circumvent rules, security features, or enhancement mechanisms
  • Use automated tools, scripts, or scraping methods without prior written permission

Perception Cards may monitor, analyze, and review activity associated with the Service to enforce these Terms, prevent abuse, and maintain system integrity.

We reserve the right to suspend or terminate access for violations of these Terms.

User Accounts

Certain features of the Service require a user account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your credentials
  • Accept responsibility for all activity under your account

You are responsible for safeguarding passwords, serial numbers, NFC-enabled credentials, access codes, or other identifiers. Loss or compromise of credentials may result in loss of access, ownership status, or enhancements, which may not be recoverable.

Perception Cards is not responsible for errors or losses resulting from inaccurate or outdated information provided by users.

Card Ownership and Transfers

Ownership of a physical collectible card does not automatically confer digital ownership within the Service.

Digital ownership is established only through successful registration and verification using required credentials, which may include serial numbers, NFC scans, or other authentication methods.

  • Each card may be associated with only one registered owner at a time
  • Transfers may require verification steps defined by the Service
  • Recovery of ownership or associated benefits is not guaranteed if credentials are lost or compromised

Ownership records, transfer history, and related metadata are provided "as-is" and do not constitute legal proof of ownership.

Enhancements, Promotional Benefits, and Preassigned Attributes

Certain physical cards may include or be associated with additional promotional benefits, enhancements, or attributes ("Enhancements"). Enhancements are attributes of specific serialized cards and are not guaranteed to be included with any particular card.

Preassignment and Disclosure

For certain releases, Perception Cards may disclose that one or more cards within a defined set have been preassigned internally to include an Enhancement.

  • Preassignment may occur before or after sale
  • Preassignment is determined solely by Perception Cards
  • Enhancements are not awarded by chance, drawing, random selection, or user entry

Activation Timing

Enhancements may be subject to deferred activation and may become claimable only during a defined activation window beginning on a specified date.

  • Only one eligible card may be active for claim at any given time
  • Activation windows, timing, and eligibility are determined in advance

Sequential Eligibility

Where multiple cards are designated as eligible for a single Enhancement:

  • Eligibility may be ordered sequentially
  • If an Enhancement is not claimed during the applicable activation window for a designated card, eligibility may expire and transfer to the next predesignated eligible card
  • Activation order and timing are fixed prior to activation and are not modified based on user behavior, demand, or outcome

Claim Requirements

To claim an Enhancement, the current holder of the eligible card must:

  • Create a free user account (if one does not already exist)
  • Register the card to their account as the current owner
  • Complete the claim action during the applicable activation window

Account creation and card registration are required solely for verification and delivery purposes and do not constitute entry into any contest, raffle, or sweepstakes.

Transfers and Secondary Market

Enhancements are tied to the card itself and transfer automatically with ownership of the card.

  • If a card is sold, gifted, or otherwise transferred before or during an activation window, eligibility passes to the current registered holder
  • Perception Cards is not responsible for disputes arising from secondary market transactions, private sales, or informal transfers

No Lottery, Raffle, or Sweepstakes

Enhancements are not part of any lottery, raffle, or sweepstakes.

  • Card ownership does not constitute entry into any game of chance
  • No purchase is required to claim an Enhancement beyond ownership of the eligible card

Expiration and Modification

Enhancements:

  • Have no cash value unless explicitly stated
  • May expire if not claimed during the applicable activation window

Perception Cards reserves the right to modify, suspend, or discontinue any Enhancement or activation process in cases including, but not limited to:

  • Fraud or attempted exploitation
  • Technical failure
  • Lost, damaged, or compromised cards or credentials
  • Circumstances affecting system integrity

Communications

By creating an account, you agree to receive transactional and service-related communications. Promotional communications may be sent subject to available opt-out mechanisms.

Limitation of Liability

To the maximum extent permitted by law, Perception Cards is not liable for indirect, incidental, special, consequential, or punitive damages, including loss of data, access, ownership status, or Enhancements.

The Service is provided on an "as-is" and "as-available" basis without warranties of any kind.

Privacy

Data collection and use are governed by our Privacy Policy, which is incorporated by reference into these Terms.

Changes to Terms

We may update these Terms from time to time. Changes are effective when posted. Continued use of the Service constitutes acceptance of revised Terms.
